Lower Cost Services: Alternatives to Custody Evaluations

Limited Family Assessment

In some cases the Court may order a Limited Family Assessment, which is substantially less expensive in time and money than a Comprehensive Child Custody Evaluation.  The savings result from the Court asking specific, fairly narrow questions in a way that limits the inquiry and the amount of data collected. In addition, the evaluator sets limits on the data flow. In contrast to the Comprehensive Evaluation, the Limited Family Assessment produces a fairly brief, focused report. The Limited Assessment may not be appropriate when there are multiple complex issues to be investigated, such as mental health and substance abuse, allegations of domestic violence, or similar concerns.

Mediation

familyMediation is a private and confidential process in which parents, with the help of a neutral third party, can negotiate some or all of their disagreements, especially about the best parenting plan for their children. Except when ordered by a court, it is entirely voluntary. Normally the only authority we have as mediators is that given to us by the parties. While we may offer information and use various conflict resolution techniques, we do not give advice or attempt to force agreement. Instead we work hard to help the parties find common ground and address all relevant issues. If both parties consent, we may draw up a Memorandum of Understanding outlining their agreements. This is not a legal document. To be binding, the final document must be prepared by an attorney selected by the parties and filed with the court.

Mediation is especially economical and effective when the participants’ conflict is mild to moderate. Parties with little conflict may not need a mediator, and parties with more serious conflict will benefit from working with a Parenting Coordinator. Those in extreme conflict may not be able to work together at all, in which case the court will have to determine what is best for their children

Parenting Consultation

A Parenting Consultation is similar to mediation, but may be even briefer.  Like mediation, the consultation is non-binding and does not constitute an evaluation or provide formal recommendations. Unlike mediation, the process will offer extensive practical advice based on the needs of the children and the wishes of the parents.  The Parenting Consultation may offer specific suggestions and propose sample custody plans.
